Move In Offer Incentive  – Terms and Conditions

1) Pinnacle Living (Vendor) is offering a special incentive to eligible purchasers of Stage 5 homes at Bellarine Springs, 101 Central Road, Drysdale VIC 3222 (Village) on the following terms and conditions (Move In Offer Incentive).

2) To be eligible for the Move In Offer Incentive, a prospective purchaser (Purchaser) must satisfy the following conditions:

a) enter a Resident & Management Agreement (Contract) with the Vendor to lease a property in Stage 5 in the Village in the form required by the Vendor, which will include special conditions relating to the terms of the Move In Offer Incentive (Contract) by the deadline specified in the Contract; and

b) reserve and settle the property in Stage 5 only in the Village between 3rd June 2020 and 28th February 2021 and in accordance with the Contract.

3) Once a Purchaser has been accepted as an eligible Purchaser and entered a Contact with the Vendor, to qualify for the Move In Offer Incentive they must satisfy the following conditions:

a) comply strictly with all of the Purchaser’s obligations under the Contract and at law until settlement of the Contract; and

b) settle by the settlement date specified in the Contract (Settlement Date).

4) The Move In Offer Incentive is to the value of up to $4,500 (exclusive of GST).

5) Prior to entering the Contract, the Purchaser choses one of the following The Move In Offer Incentives:

Option 1: Move in ‘on us’:

a) This applies to removalists, or white goods, or curtains or new furniture used for the new property at the Village, to a maximum value of $4,500. The initial cost is to be paid by the Purchaser, and the Vendor will pay The Move In Offer Incentive to the Purchaser by way of adjustment in the statement of adjustments at Settlement in the Purchaser’s favour.

b) Prior to settlement of the Contract (Settlement), the Purchaser is required to provide receipts of the services or products used to help move or set up the property in the Village (maximum $4,500 + GST). The Vendor needs to be satisfied that these receipts are related to the Purchaser’s move to the Village.

c) Upon Settlement, provided the Purchaser has complied with these terms and conditions and the Contract in all respects, the Vendor will pay The Move In Offer Incentive to the Purchaser by way of adjustment in the statement of adjustments in the Purchaser’s favour.

Option 2: Zero service fees for 12 months:

a) Upon settlement of the Contract (Settlement), provided the Purchaser has complied with these terms and conditions and the Contract in all respects, the Vendor will pay The Move In Offer Incentive to the Purchaser by way of adjustment in the service fees to zero for the first 12 months of occupation in the Purchaser’s favour.

b) The Move In Offer Incentive will automatically cease should the Purchaser exit the Village after Settlement, but within 12 months of Settlement.

Option 3: Holiday in Australia:

a) Upon settlement of the Contract (Settlement), provided the Purchaser has complied with these terms and conditions and the Contract in all respects, the Vendor will provide The Move In Offer Incentive to the Purchaser by way of presenting a $4,500 + GST travel voucher in the name of the Purchaser.

6) The Move In Offer Incentive is not available in conjunction with any other incentives offered by the Vendor at any time and cannot be redeemed for cash or as a discount on the purchase price and cannot be transferred to another party.

7) If the Contract is terminated for any reason prior to Settlement, the Move In Offer Incentive will automatically cease.

8) The Vendor may revoke the Move In Offer Incentive at any time if the Purchaser breaches these terms and conditions or the Contract at any time prior to Settlement.

9) These terms and conditions do not constitute a binding contract between the Vendor and Purchaser and any eligibility for the Move In Offer Incentive will be subject to the parties entering a formal Contract containing special conditions reflecting the terms of the Move In Offer Incentive. The terms of the Contract will prevail over these terms and conditions.

10) The Vendor accepts no responsibility for late, lost or misdirected communications.

11) If The Move In Offer Incentive is unavailable for reasons beyond the Vendor’s control, the Vendor reserves the right to substitute The Move In Offer Incentive with an incentive of equal or greater monetary value. This right is subject to any applicable legislation, regulations or directions from a regulatory authority.

12) The Purchaser’s use of The Move In Offer Incentive is entirely at their own risk. Before The Move In Offer Incentive is provided, the Purchaser may be required to sign an agreement to release the Vendor from and indemnify the Vendor against any liability arising from or in connection with The Move In Offer Incentive.

13) Any service or product supplied by a third party supplier as part of The Move In Offer Incentive is subject to the terms and conditions of that third party supplier.

14) The Vendor reserves the right to vary the terms of, or cancel, the of The Move In Offer Incentive at any time without liability to any Purchaser or other person, subject to applicable laws.
